Senate Majority Leader Chuck Schumer recently discussed a long-shot idea with Sen. Joe Manchin: Making a late entry into the US Senate race in West Virginia to try to hold on to his seat as an independent. Manchin, who threw cold water on the idea and is still planning on retiring from the Senate, confirmed to CNN that he’s discussed the last-ditch bid with Schumer. “I think that’s a long, long, long-shot scenario,” Manchin said of running as an independent candidate. Time may be finally running out on the filibuster, the signature dilatory tactic in the Senate embraced by some as a protector of minority rights and reviled by others as an outdated weapon of partisan obstruction. With the announcement by Senator Kyrsten Sinema of Arizona that she will not seek re-election, the filibuster is now on track to lose the two senators who preserved it in 2022 over the objections of the rest of their party. She and her fellow filibuster defender, Senator Joe Manchin III of West Virginia, who is also retiring, left Democrats just two votes short of ending the filibuster when it came to voting law changes that were backed by a majority. Perhaps just as significantly, Senator Mitch McConnell, the Kentucky Republican who has enthusiastically deployed the filibuster to his advantage for decades, is stepping down from his top party leadership post, reducing the influence of one of the chief practitioners and defenders of filibuster maneuvering. Depending on how the November elections shake out, the pressure to reduce the power of the procedural tool — which effectively requires 60 votes to move any legislation forward in the Senate — could be substantial.

WASHINGTON (AP) — Twenty-four Republican-led states filed a lawsuit Wednesday challenging a new Biden administration rule that sets tougher standards for deadly soot pollution. The EPA rule “will drive jobs and investment out of Kentucky and overseas, leaving employers and hardworking families to pay the price,” Coleman said. The soot rule is one of several EPA dictates under attack from industry groups and Republican-led states. Soot pollution has declined by 42% since 2000, even as the U.S. gross domestic product has increased by 52%, Regan said. The EPA said it will work with states, counties and tribes to account for and respond to wildfires, an increasing source of soot pollution, especially in the West.
